1. Acceptance of these Terms

These Terms and Conditions govern your use of piercommercial.com, our tenant and vendor maintenance portal at piermaintenance.com, and any related pages we operate (together, the “Sites”). By using the Sites you agree to these Terms. If you do not agree, please do not use them.

2. Who we are

The Sites are operated by PIER Commercial Real Estate Management, LLC, a Georgia limited liability company with offices at 5105 Paulsen Street, Suite 200A, Savannah, Georgia 31405 (“PIER,” “we,” “us,” or “our”). We provide commercial real estate management and related services in the Savannah, Georgia area.

3. Informational purpose only

Content on the Sites is provided for general information. Property descriptions, availability, square footage, rental rates, images, and similar details are believed accurate when published but are not warranted, may change without notice, and may be withdrawn at any time. Nothing on the Sites is an offer to lease, sell, or transact, and nothing on the Sites should be relied upon as legal, tax, financial, or investment advice.

4. No brokerage or agency relationship

Using the Sites, submitting a form, or contacting us through them does not create a brokerage, agency, fiduciary, or client relationship between you and PIER. Any such relationship arises only under a separate written agreement signed by both parties.

5. The maintenance portal

The portal at piermaintenance.com is provided for tenants, authorized occupants, and service vendors of properties we manage. By submitting a service request you confirm that you are authorized to do so for the suite or premises identified, and that the information you provide is accurate.

The portal is not monitored continuously and is not an emergency service. For fire, gas odor, medical emergency, or any threat to life or property, call 911 first. For an after-hours building emergency, use the emergency contact number in your lease rather than the portal.

Submitting a request does not guarantee a particular response time, a particular vendor, or that the work will be performed at our expense. Whether a repair is our obligation or the tenant’s is determined by the applicable lease.

6. Maintenance responsibility

Certain categories of maintenance are the tenant’s obligation under the lease. Where a request falls into such a category, the portal will tell you so at the time of submission and will route the request to the tenant’s designated owner or corporate contact instead of dispatching it at the landlord’s expense. Category selection in the portal is a convenience for routing. It does not modify the lease, and the lease governs in the event of any conflict.

7. Vendors and contractors

To perform requested work we engage third-party vendors and contractors. We share with the assigned vendor only what is operationally necessary, which includes the property and suite, the reported issue, any photographs or video you attach, and a contact name and telephone number so the vendor can arrange access. Vendors are independent contractors and are not our employees or agents. We are not responsible for their acts or omissions beyond our own supervision obligations under the applicable management or lease agreement.

8. SMS messages

Tenants may optionally consent to receive automated service-status text messages about a request they have submitted. Consent is given by checking an unchecked box on the request form and is not a condition of service or of any lease obligation. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Opting out of text messages does not affect your service request. See our Privacy Policy for how SMS information is handled.

9. Acceptable use

You agree not to use the Sites to submit false, fraudulent, or unauthorized requests; to upload unlawful, infringing, or malicious content; to attempt to access accounts, data, or systems you are not authorized to access; to interfere with the operation of the Sites; or to use automated means to scrape or collect content without our written permission.

10. Content you submit

You retain ownership of photographs, video, and descriptions you submit. You grant us a non-exclusive, royalty-free license to use that content for the purpose of evaluating, dispatching, performing, documenting, and, where applicable, billing the work requested, and to retain it as part of the property’s maintenance record. You represent that you have the right to submit it and that it does not violate anyone else’s rights.

11. Our content

The Sites and their text, graphics, logos, and software are owned by PIER or its licensors and are protected by applicable intellectual property laws. The PIER name and logo may not be used without our prior written permission. You may view and print pages for your own non-commercial use.

The Sites may link to sites we do not control. We provide those links for convenience only and are not responsible for the content, accuracy, or practices of those sites.

13. Disclaimer of warranties

THE SITES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Sites will be uninterrupted, timely, secure, or error-free, or that any request submitted through them will be received.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW, PIER AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Nothing in these Terms limits any obligation PIER owes under a lease or management agreement, or any liability that cannot be limited by law.

15. Indemnification

You agree to indemnify and hold harmless PIER and its members, managers, officers, employees, and agents from any claim, loss, or expense, including reasonable attorneys’ fees, arising from your misuse of the Sites, your breach of these Terms, or content you submit.

16. Governing law and venue

These Terms are governed by the laws of the State of Georgia without regard to its conflict-of-laws rules. Any action arising out of or relating to these Terms or the Sites shall be brought exclusively in the state or federal courts located in Chatham County, Georgia, and you consent to that jurisdiction and venue.

17. Changes

We may revise these Terms at any time by posting an updated version with a new “Last updated” date. Continued use of the Sites after that date constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
